Which of your data is processed by us and for what purpose?

If we have received data from you, we will only process it for the purposes for which we received or collected it.

Data processing for other purposes only comes into question if the necessary legal requirements according to Art. 6) Section 4 GDPR are satisfied. In this case we will of course comply with any information obligations per Art. 13) Section 3 GDPR and Art. 14) Section 4 GDPR.

On what legal foundation is this based? The legal basis for the processing of personal data is in principle Art. 6 GDPR, unless specific legislation exists. The following possibilities are particularly relevant here:

  • Consent (Art. 6) section 1 lit. a) GDPR)
  • Data processing for the execution of contracts (Art. 6) section 1 lit. b) GDPR
  • Data processing based on a balancing of interests (Art. 6) section 1 lit. f) GDPR)
  • Data processing for the fulfilment of a legal obligation (Art. 6) section 1 lit. c) GDPR)
  • If personal data is processed on the basis of your consent, you have the right to revoke this consent at any time with effect for the future.

If we process data on the basis of a balancing of interests, you as the data subject have the right to object to the processing of personal data, taking into account the provisions of Art. 21 GDPR.

How long are the data stored for?

We process the data for as long as this is necessary for the respective purpose.

Insofar as there are legal storage obligations – e.g. in accordance with commercial law or tax law – the relevant personal data is stored for the duration of the storage obligation. After expiry of the obligation to retain data, a check is made to determine whether there is any further requirement for processing. If there is no further requirement, the data is deleted.

As a matter of principle, towards the end of a calendar year we carry out an examination of data with regard to the need for further processing. Due to the volume of data, this examination is carried out with regard to specific types of data or the purpose of processing.

Of course, you can request information at any time (see below) regarding your personal data stored by us and, if storage is unnecessary, request that the data be deleted or processing restricted.

To which recipients will the data be forwarded?

Your personal data will only be passed on to third parties if this is necessary for the execution of the contract with you, if the passing on is permitted on the basis of a weighing of interests in accordance with Art. 6) Section 1 lit. f) GDPR, if we are legally obliged to pass on the data or if you have given your consent.

Where is the data processed?

Your personal data is processed by us exclusively in data centres within the Federal Republic of Germany/European Union.

Your rights as a “data subject”

You have the right to be informed about the personal data we process about you.

In the case of a request for information that is not made in writing, we ask for your understanding that we may then require you to provide evidence that proves that you are the person you claim to be.

Furthermore, you have the right to correction or deletion or to restriction of processing, insofar as you are legally entitled to do so.

Furthermore, you have the right to object to the processing within the scope of the statutory provisions. The same applies to a right to data transferability.

In particular, you have a right to object per Art. 21) Section 1 and 2 GDPR to the processing of your data in connection with a direct marketing campaign, if this is based on a weighing of interests.
